Terms of Service

1. About this service

Nelkins Technologies FZ-LLC operates Broker OS, a software platform for real-estate brokers and brokerages. Nelkins Properties is the related real-estate agency brand and public service domain. These terms govern use of the software product; they do not appoint the software operator as your broker or authorise it to execute a property transaction on your behalf.

2. Eligibility

You must be at least 18 years old, hold a valid broker registration where required for licensed activity, and be authorised to act for any brokerage you represent in the platform.

3. Plans, trials and billing

  • The free plan is offered subject to the fair-use limits shown in-product.
  • Paid plans are billed in advance through Stripe at the price shown at checkout.
  • Promotional pricing and trials are subject to the displayed eligibility and duration.
  • You can cancel from Settings; cancellation normally takes effect at the end of the paid period.

4. Your content and data

You retain rights to the contacts, listings, messages, documents and other content you store. You grant Nelkins Technologies a limited licence to host, process and display that content solely to operate the service and provide features you request. We do not sell your content or use it to train models for other customers or shared general-purpose models.

5. Connected mailboxes and communication channels

A mailbox or communication channel is not connected merely because you use the same address to sign in. You must expressly authorise the provider permissions shown before connection. Where you grant sending permission, the service may send through user-directed, approved or configured workflows. Where you grant mailbox read permission, the service may synchronise bounded message data for private CRM history, reply detection, follow-up suppression and optional user-facing intelligence as described in the Privacy Policy.

You may disconnect a provider or revoke access through the provider at any time. Disconnection removes stored credentials and stops future provider access. Previously imported business records may remain until you delete them or request deletion, subject to legal retention obligations.

6. Acceptable use and communication compliance

You must not use the service to:

  • send unsolicited bulk messages or evade consent, suppression or provider rules;
  • upload or distribute content that infringes rights or violates applicable regulation;
  • misrepresent property availability, authority, identity or evidence;
  • reverse-engineer, resell or sub-license the platform except under a written agreement; or
  • attempt to access another user's or tenant's data.

7. AI-assisted features

AI outputs are assistance, not guaranteed facts, legal advice or a substitute for professional review. You remain responsible for checking and approving customer-facing content before sending. Optional style learning requires a separate user opt-in and can be disabled or reset.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, provider outages and emergency security work may cause temporary unavailability.

9. Termination

We may suspend or terminate accounts that materially breach these terms, with notice where reasonable. Following termination, export or deletion options are subject to the product's retention and legal-obligation rules.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses. Aggregate liability is capped at the fees paid for the service in the 12 months preceding the claim, except where law does not permit that limitation.

11. Governing law

These terms are governed by the laws identified in the contracting order or subscription agreement. Where no separate agreement applies, disputes are subject to the courts of the Dubai International Financial Centre unless another forum is required by applicable law.
